Terms of Service

These Terms of Service ("Terms") govern your access to and use of Sociary ("Sociary", "we", "us") and our web application at https://sociary.cloud(the "Service"). The Service is operated by Marco Pollmann, Schwalenbergstr. 7, 33428 Marienfeld, Germany. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Sociary is an analytics and content-planning assistant that helps creators understand the performance of their Instagram and TikTok accounts, plan and schedule content, create hook and demo videos, generate AI-assisted media, and receive recommendations. Features may change over time.
2. Eligibility & accounts
You must be old enough to hold a TikTok and/or Instagram account in your jurisdiction and able to form a binding contract. You are responsible for the information you provide, for activity under your account, and for keeping your credentials secure.
3. Connecting social accounts
To use certain features you may connect your TikTok and/or Instagram accounts via their official OAuth flows. By connecting an account you authorize Sociary to access and process data and to perform actions (such as publishing or scheduling posts) that you initiate, within the scopes you grant. You may disconnect at any time in Settings or by revoking access in the respective platform.
Your use of TikTok and Instagram remains subject to their own terms and policies. You agree not to use Sociary in any way that violates the TikTok Terms of Service or the Instagram Terms of Use.
4. Acceptable use
You agree not to:
- Use the Service for spam, automated abuse, or content that violates platform rules or applicable law.
- Attempt to access data of accounts you do not own or are not authorized to manage.
- Reverse engineer, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
- Publish content through the Service that is unlawful, infringing, or harmful.
- Use AI-generated or third-party media without the rights required to publish it on connected platforms.
5. Your content
You retain ownership of the content you create and publish. You grant us a limited license to host, process, and transmit your content solely to provide the Service (e.g. to store media in your library, render videos, or publish a post you schedule). You are responsible for ensuring you have the rights to any content you upload, generate, or publish through Sociary.
6. AI-generated suggestions and media
Recommendations, insights, drafts, images, and videos may be generated automatically using third-party AI providers (including DeepSeek and fal.ai). Outputs are provided for informational and creative assistance only. They may be inaccurate, incomplete, or unsuitable for publication. You are responsible for reviewing any content before publishing. We do not guarantee any particular growth, reach, or results.
7. Subscriptions & billing
Some features require a paid plan. Pricing, trial terms, and plan limits are shown in the app. Payments are processed by Stripe. Where applicable, fees are billed in advance. Refunds are handled in accordance with applicable consumer law and any terms shown at checkout. You may cancel a subscription according to the options provided in the app or through Stripe customer billing management where available.
8. Third-party services
The Service integrates with third parties required to operate Sociary, including Supabase, Netlify, Stripe, DeepSeek, fal.ai, Google (for optional sign-in), TikTok, and Meta/Instagram. We are not responsible for third-party services, and their availability or terms may change. How these providers handle data is described in our Privacy Policy.
9. Availability
We aim to keep the Service available but do not guarantee uninterrupted access. Maintenance, platform API changes, or third-party outages may temporarily affect features such as analytics sync, publishing, or AI generation.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, Sociary and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the Service. Mandatory statutory liability (including for injury to life, body, or health, or under the German Product Liability Act) remains unaffected.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that could harm us, other users, or the connected platforms.
13. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. If you are a consumer resident in the EU, mandatory consumer protection laws of your country of residence remain unaffected. The courts at the operator's place of business in Germany shall have jurisdiction where permitted by law.
14. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
